Custom production

If the subject of the purchase contract, which has been concluded via an online shop or other means of distance communication by the buyer who is a consumer, is the provision of a service (e.g. an order for the production of final work plates or printing) and if the term of performance specified in the (online) order is shorter than the 14-day statutory withdrawal period, the consumer requests under Section 1823 of the Civil Code that the seller commence performance of the subject of the purchase contract before the expiry of the statutory withdrawal period. The buyer-consumer acknowledges and agrees that if the term of performance is shorter than the statutory withdrawal period, the consumer's right to withdraw from the contract is limited (Sections 1834 and 1837 of the Civil Code).

§ Section 1834: If the consumer withdraws from a contract whose subject matter is the provision of services and the entrepreneur has started performance at the consumer's express request before the expiry of the withdrawal period, the consumer shall pay the entrepreneur the full amount of the agreed price for the performance provided up to the time of withdrawal.

§ Section 1837: The consumer may not withdraw from a contract: a) for the provision of services if the services have been performed with his prior express consent before the expiry of the withdrawal period and the entrepreneur has informed the consumer before the conclusion of the contract that in such a case he has no right to withdraw from the contract.
